1. Acceptance of Terms
By accessing or using the NEOS AI Security API (the "API") provided by NE-OS AI Security SpA, a company organized under the laws of the Republic of Chile, with registered address at Parcela 37 lote 5 casa N°11, Villa Alfalfares, La Serena, Región de Coquimbo, Chile (the "Company"), you ("Client") agree to be bound by these Terms of Service. The API is made available exclusively to business entities (B2B) and is not intended for individual consumers or self-service use. If Client does not agree, it must not use the API.
2. Authorized Use
Client is granted a non-exclusive, non-transferable, revocable license to access and use the API solely for: conducting authorized penetration tests on Client's own infrastructure or systems under Client's control; performing vulnerability detection, security scanning, and risk analysis with prior written consent from the target system owner; and generating reports and remediation recommendations for internal security improvements.
3. Prohibited Use
Client agrees not to: use the API for any illegal activity including unauthorized access to computer systems; access, scan, or test any system without prior explicit written authorization from the system owner; reverse-engineer, decompile, or disassemble the API or its underlying technology; sell, resell, rent, or sublicense access to the API to any third party without express written consent; or use the API for self-service, automated subscription, or consumer-facing applications.
4. Liability Limitation
The API is provided "as is" and "as available" with no warranties, express or implied. In no event shall NE-OS SpA be liable for any indirect, incidental, special, consequential, or punitive damages. The Company's total liability shall not exceed the total fees paid by Client in the twelve (12) months preceding the event giving rise to the claim.
5. Termination
Access may be terminated immediately upon written notice if Client breaches these Terms or engages in prohibited use. Client must immediately delete all API credentials and confidential information upon termination. Sections 4, 6, and 7 survive termination.
6. Governing Law
These Terms are governed by the laws of the Republic of Chile. Any dispute shall be resolved exclusively in the courts of Santiago, Chile.
